1. Arbitration clause for the contract
(1) If the parties wish to transfer the dispute for settlement in accordance with the CAC Regulation, they may include an arbitration clause in their contract in the following form:
All disputes or claims arising from or related to this contract, including disputes related to its validity, violation, termination or invalidity, must be finally resolved according to the Regulations of the Court of Arbitration for Sport under the National Olympic Committee of Ukraine by one or three arbitrators appointed in accordance with this Regulation.
(2) The parties may additionally agree in the arbitration clause on the number of arbitrators (one or three) (Article 15(1) of the CAC Regulation), the language of the arbitration proceedings (Article 24(1) of the CAC Regulation).
2. Arbitration clause for sports entities
(1) If a sports entity (a national federation for a certain sport, etc.) intends to provide in its statutory documents for the possibility of transferring disputes between its members for settlement in accordance with the CAC Regulations, it may include in its charter an arbitration clause, in particular, but not exclusively, in the following form:
Decisions, actions and/or inaction of the governing bodies [name of the subject of sports], if there are grounds for that, may be appealed by a member of the [name of the subject of sports], whose rights and/or legitimate interests have been violated, to the Court of Arbitration for Sport under the National Olympic Committee of Ukraine for final decision by one or three arbitrators appointed in accordance with the Regulations of the Court of Arbitration for Sport under the National Olympic Committee of Ukraine in the manner specified by these Regulations.
(2) If the subject of sports (national federation for a certain type of sport, etc.) intends to provide in its (disciplinary) statutory documents for the possibility of appealing decisions issued by its disciplinary bodies (disciplinary (qualification) commissions, dispute resolution chambers, sports tribunals, etc.) in the order of appeal in accordance with the Regulations of the SAC, it may include in its charter an arbitration clause, in particular, but not exclusively, in the following form:
Any decision [name of the disciplinary body of the subject of sport] may be finally appealed exclusively in the order of appellate arbitration proceedings under the Regulations of the Court of Arbitration for Sport under the National Olympic Committee of Ukraine by one or three arbitrators appointed in accordance with these Regulations within 30 days from the moment the challenging party receives the contested decision.
